COUNCIL OF MINISTERS REGULATIONS TO PROVIDE FOR THE ESTABLISHMENT OF THE WATER WORKS DESIGN AND SUPERVISION ENTERPRISE
These Regulations are issued by the Council of Ministers pursuant to Article 5 of the Definition of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 4/1995 and Article 47 (1) (a) of the Public Enterprises Proclamation No. 25/1992.
1. Short title
These Regulations may be cited as the "Water Works Design and Supervision Enterprise Establishment Council of Minister Regulations No. 42/1998"
2. Establishment
- The Water Works Design and Supervision Enterprise (hereinafter "the Enterprise") is hereby established as a public enterprise.
- The Enterprise shall be governed by the Public Enterprises Proclamation No. 25/1992.
3. Supervising Authority
The ministry of water resources shall be the supervising authority of the Enterprise.
4. Head Office
The Enterprise shall have its head office in Addis Ababa and may have branch offices elsewhere as may be neccessary.
5. Purposes
The purposes for which the Enterprise is established are:
- to conduct studies pertaining to hydraulics, dams,irrigation, water supply, industry, sewerage disposal water works, and basin development master plans;
- to carry out surveys, designs and specifications regarding hydrualics, hydro power, geotechnic, dam and irrigation structures, flood control, water supply, sewerage disposal and other related water works;
- to render consultancy services regarding contract administration and supervision pertaining to water works;
- to render service regarding water works studies and design evaluation;
- to render services regarding the preparation of bid and contract documents, and selection of contractors' concerning water works;
- to engage in other related activities necessary for the attainment of its purposes.
6. Capital
The authorized capital of the Enterprise is Birr 35,235,672.04 (thirty five million two hundred thirty five thousand six hundred seventy two birr and four cents) which is fully paid up in cash and in kind.
7. Liability
The Enterprise shall not be liable beyond its total assets.
8. Duration
The Enterprise is established for an indefinite duration.
9. Effective Date
These Regulations shall come into force on the 9thday of October 1998.
